  2. Any online facilities, tools, services or information that Scan Com Distribution Ltd makes available through the Website (the Service) is provided "as is" and on an "as available" basis. We give no warranty that the Service will be free of defects and/or faults. To the maximum extent permitted by the law, we provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality. 4. Scan Com Distribution Ltd accepts no liability for any disruption or non-availability of the Website.
  5. Scan Com Distribution Ltd reserves the right to alter, suspend or discontinue any part (or the whole of) the Website. Changes to goods or services you have already bought are covered by the sections below.

Buying goods online

  1. Your order is an offer to buy. We accept your order when we email you to confirm we have dispatched the goods. We may refuse an order, for example if an item is out of stock, if we cannot verify your payment, or if we suspect fraud. If we refuse your order, we will tell you and will not charge you.
  2. All prices include VAT. Delivery charges are shown at checkout.
  3. If we find a clear pricing error before we dispatch your order, we will contact you. You can then buy at the correct price or cancel for a full refund.
  4. We will deliver to the address you give us within the time shown at checkout. If delivery is delayed by events outside our control, we will tell you. If the delay is significant, you can cancel and get a refund for anything you have paid for goods not received.
  5. If you bought through Amazon or another marketplace, that marketplace's returns process applies alongside your legal rights.

Cancelling and returning goods

  1. You can cancel your order for any reason within 14 days of the day you receive the goods. Opening the packaging does not remove this right. You do not have to give a reason.
  2. To cancel, email support@scancom.co.uk with a clear statement that you want to cancel.
  3. After you cancel, return the goods within 14 days to the address we give you. Unless the goods are faulty or not as described, you pay the cost of returning them.
  4. We will refund the price and standard delivery cost within 14 days of receiving the goods back, or of you showing us proof of return if that is earlier. We may reduce the refund if the goods have been handled more than needed to inspect them, in the way you could in a shop.
  5. If you cancel a SIM card linked to a subscription, the cancellation rules in the "Data SIM Subscriptions" section apply to the service.

Faulty goods

  1. Goods must be as described, fit for purpose and of satisfactory quality.
  2. If goods are faulty, you can get a full refund within 30 days of delivery. After 30 days, we will repair or replace the goods, or give you a refund if that is not possible. This does not affect your other legal rights.

Data SIM Subscriptions

This section applies if you subscribe to one of our data SIM services, whether you subscribe on our Website or buy a SIM pack in a shop.

Your contract

  1. Your subscription contract is with Scan Com Distribution Ltd, even if you bought your SIM pack in a shop. Shops that sell our SIM packs are not party to this contract and cannot change these terms.
  2. To subscribe, you must be 18 or over and live in the UK.

The service

  1. Our data SIMs provide a data-only mobile service on the network shown on your plan (for example O2, Three or Vodafone). The service does not include calls, texts or premium-rate services.
  2. You can use the SIM in phones, tablets, mobile broadband routers and other compatible devices. You are responsible for making sure your device is compatible and unlocked.
  3. The service works in the UK only, unless your plan says otherwise.

No emergency calls

  1. You cannot use a data-only SIM to call 999 or 112. Do not rely on this service as your only way to contact the emergency services, or for alarms, medical devices or other safety-critical systems.

Coverage and speeds

  1. 5G is available where there is 5G coverage and you use a 5G-compatible device. Otherwise the service uses 4G or 3G.
  2. Please check coverage at your address before you buy, using your network's online coverage checker.
  3. Speeds depend on your location, device, the building you are in and how busy the network is. Typical speeds for your plan are available from us on request. We cannot guarantee coverage or speeds.

Unlimited data and fair usage

  1. "Unlimited" plans are subject to the fair usage policy of the network your SIM uses, such as O2 or Vodafone, as published by that network from time to time.
  2. If you go over the network's fair usage limit in a billing month, your data may be slowed or paused until your next billing date, in line with that network's policy.
  3. We will try to let you know by email when you are close to the limit.

Using the service properly

  1. You must not use the service to resell connectivity, to run SIM boxes or gateways, for anything illegal, or in a way that harms the network or other customers.
  2. If you do, we may suspend or end your subscription after telling you. We may act straight away if there is a risk of fraud or harm to the network.
  3. The SIM card remains the property of us or our network partner. You may only use it with the service and must not damage, copy or tamper with it.

Price and payment

  1. The monthly price is shown at checkout and includes VAT. There is no activation fee and no exit fee.
  2. You pay monthly in advance by card through our payment provider, Stripe. Your first payment is taken when you subscribe. Later payments are taken on the same date each month (your billing date) until you cancel. Your subscription renews automatically each month.
  3. If a payment fails, we will retry it and email you. If it is still unpaid after 7 days, we may suspend the service. If it is still unpaid after 14 days, we may end your subscription.
  4. Please contact us before raising a dispute with your card provider, so we can try to put things right quickly.

Price changes

  1. By subscribing, you agree that we may change the price of your subscription from time to time.
  2. We will give you at least one month's notice of any price increase by email, showing the new price in pounds and pence.
  3. If you do not want to pay the new price, you can cancel without charge at any time before the change takes effect.

Contract summary

  1. We will give you a contract summary before you subscribe. If that is not possible, for example when you buy a SIM pack in a shop, we will email it to you before we activate your service. Your contract starts when you confirm you agree to it.

Activation

  1. We usually activate your SIM within 1 business day of your first payment. Activation may take longer if we need to carry out fraud or identity checks.
  2. If your SIM is not active within 3 business days, please contact us. If we cannot activate it within 7 business days, you can cancel for a full refund.

Your 14-day right to cancel

  1. You can cancel your subscription for any reason within 14 days of the day you subscribe. You do not have to give a reason.
  2. When you subscribe, you ask us to start your service straight away. If you cancel within the 14 days, you only pay for the days you had the service, worked out pro rata from your monthly price. We will refund the rest within 14 days.
  3. To cancel, use your customer portal or email support@scancom.co.uk with a clear statement that you want to cancel.

Cancelling at any time

  1. After the first 14 days, you can cancel at any time through the customer portal link in your subscription emails or by emailing support@scancom.co.uk. There is no minimum term and no exit fee.
  2. Once you cancel, you will not be charged again. Your service continues until the end of the month you have already paid for. We do not refund part months, except where the law requires it.

Lost or stolen SIMs

  1. Tell us straight away if your SIM is lost or stolen and we will bar it. You are responsible for use of the SIM until you tell us.
  2. Contact us for a replacement SIM. We will tell you about any charge before we send it.

Switching

  1. To move your number to another provider, contact us and we will give you a PAC code.
  2. Your subscription ends when the switch completes, and you will not be charged after that.

Suspending or ending the service

  1. We may suspend or end your service if you break these terms, if we reasonably suspect fraud or misuse, or if our network partner or the law requires it. Unless it is urgent, we will tell you first and give you a chance to put things right.
  2. We may suspend the service for planned maintenance or network changes, and will try to give you notice.
  3. If we end the service for any other reason, we will give you at least one month's notice and refund anything you have paid for service you will not receive.

Changes to the service and these terms

  1. We may change these terms or the service, including our network partner, to reflect changes in law, regulation, our suppliers or our business.
  2. If a change is not only to your benefit and is not required by law, we will give you at least one month's notice. You can then cancel without charge within one month of that notice.

Complaints

  1. If you are unhappy, please contact support@scancom.co.uk. You can ask us for a copy of our complaints code at any time.
  2. If your complaint is not resolved within 8 weeks, or we write to tell you we cannot resolve it, you can take it free of charge to our Ofcom-approved alternative dispute resolution scheme. We will give you the scheme's details when we respond to your complaint.

Your data

  1. To provide the service, we share your details with our network partner and with Stripe.
  2. If you bought your SIM pack in a shop, we share only your SIM number with that shop, so we can pay them for the sale. We do not share your contact details with the shop.

Business customers

  1. This section applies if you buy goods or services for purposes related to your trade, business or profession. Where it conflicts with other sections, this section applies.
  2. The 14-day cancellation rights for goods and subscriptions apply to consumers only. Business subscriptions can still be cancelled at any time under "Cancelling at any time".
  3. We will not be liable to business customers for loss of profit, revenue, business, data or goodwill, or for any indirect or consequential loss. Our total liability to a business customer in any 12-month period is limited to the total amount paid to us in that period.

Limitation of liability

  1. Nothing in these terms and conditions will:
    (a) limit or exclude our or your liability for death or personal injury resulting from our or your negligence, as applicable;
    (b) limit or exclude our or your liability for fraud or fraudulent misrepresentation; or
    (c) limit or exclude any of our or your liabilities in any way that is not permitted under applicable law, including your statutory rights as a consumer.
  2. If you are a consumer, we will provide our services with reasonable care and skill. We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill.
  3. To the maximum extent permitted by law, Scan Com Distribution Ltd accepts no liability for any of the following:
    1. any business losses, such as loss of profits, income, revenue, anticipated savings, business, contracts, goodwill or commercial opportunities;
    2. loss or corruption of any data, database or software;
    3. any special, indirect or consequential loss or damage that was not foreseeable.

Events outside our control

  1. We will not be liable to you in respect of any losses arising out of events beyond our reasonable control, such as network outages.
  2. If this happens, we will contact you as soon as possible and take steps to reduce the effect. If the problem lasts more than 30 days, you can cancel and get a refund for anything you have paid for and not received.

General

  1. You may not transfer any of your rights under these terms and conditions to any other person without our written agreement. We may transfer our rights and obligations under these terms and conditions to another organisation. We will tell you in writing if this happens and make sure the transfer does not affect your rights. If you are unhappy with the transfer, you may cancel your subscription without charge.
  2. These terms and conditions may be varied by us from time to time. Such revised terms will apply to the Website from the date of publication. Changes affecting an active subscription follow the "Changes to the service and these terms" section. Users should check the terms and conditions regularly to ensure familiarity with the then current version.
  3. These terms and conditions together with the Privacy Policy and Cookies Policy contain the whole agreement between the parties relating to its subject matter and supersede all prior discussions, arrangements or agreements that might have taken place in relation to the terms and conditions.
  4. The Contracts (Rights of Third Parties) Act 1999 shall not apply to these terms and conditions and no third party will have any right to enforce or rely on any provision of these terms and conditions.
  5. If any court or competent authority finds that any provision of these terms and conditions (or part of any provision) is invalid, illegal or unenforceable, that provision or part-provision will, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of these terms and conditions will not be affected.
  6. Unless otherwise agreed, no delay, act or omission by a party in exercising any right or remedy will be deemed a waiver of that, or any other, right or remedy.
  7. This Agreement shall be governed by and interpreted according to the law of England and Wales. Disputes arising under the Agreement (including non-contractual disputes or claims) shall be subject to the jurisdiction of the courts of England and Wales. If you are a consumer living in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
